Please read these terms and conditions carefully which set out the basis on which you can order and buy products through our online delivery service.

1.              About Us

1.1          The Model Rail Offers website is operated by Kernow Model Railway Centre (‘Supplier’ or ‘We’ or ‘Us’) on behalf of H Bauer Publishing (‘Bauer’) a company registered in England (company number LP003328) with registered offices at Academic House, 24-28 Oval Road, London, NW1 7DT.

1.2       These terms and conditions (‘Terms and Conditions’) will apply to any contract between Bauer and the customer (‘Customer’) for the sale of diesel and steam locomotives (the ‘Products’). The Customer will purchase the Products directly from the Supplier’s website who will be responsible for the dispatch of the Products directly to the Customer from its warehouse. Any return of the Products will be subject to our returns policy at clause 5. 

2.         Description and Product Availability

2.1       The images of the Products on our site are for illustrative purposes only. Although We have made every effort to ensure that the Products are fairly described and that the colours of the Products are displayed as accurately as possible, the actual colours you will see will vary with the quality of your monitor. We cannot therefore guarantee that your display will accurately reflect the colour of the Products reflected on delivery.

2.2       All Products shown on the site are subject to stock availability. We will inform you by email as soon as possible if the Products you have ordered are not available and We will not process your order until such time when they are available.

2.3      We aim to process all orders as quickly as possible and usually within 48 hours of payment being made and authorisation of the card payment. We will not be held responsible for any unavoidable delays beyond our reasonable control.

2.4       Except for items which have been processed as advance orders, Products will be delivered within 30 days from the date of the order, although usually much sooner. If there is, or likely to be, a delay beyond this timeframe for whatever reason We will inform you immediately. If the delay is not acceptable to you We will cancel the order if you instruct us to do so and will offer you a full refund.

3.         Price of Products and Postal Charges

3.1       The price of the Product(s) shown in the description is the standard sale price. If you are a Model Rail subscriber, you are eligible for a discount. You must enter your subscriber number in the customer message field when placing your order to be eligible for your subscriber discount. The discount will then be verified and applied manually.   

3.2       The price of the Product(s) may change from time to time, but changes will not affect any order which has been processed. The price of the Product(s) includes VAT at the current rate chargeable in the UK for the time being. However, if the rate of VAT changes between the date your order was placed and the date of dispatch, we will adjust the VAT you pay, unless you have already paid for the Product(s)s in full before the change in VAT takes effect.

3.3       The price of the Product(s) does not include postal charges unless otherwise stated. Our postal charges are as shown on our site and can be found here.

4.         How to Pay

You can only pay for Products using a debit card or credit card. We accept the following cards: Visa, Mastercard, Maestro and JCB.

5.         Your Right of Return and Refund

5.1       If you wish to return your purchase because you have changed your mind you have 14 days in which to do this. The Product(s) must be in the original packaging and you will be responsible for the cost of returning your purchase to us.

5.2       We always aim to supply high quality Products that are free from faults or damage. On occasion however, Products supplied by us may need to be returned and such returns are governed by these Terms and Conditions. As a consumer, you will always have legal rights in relation to Products that are faulty or not as described.

5.3       If you receive Products that you have purchased from us which do not match the description when you placed the order and you do not wish to accept the Product(s), we will either replace the Product(s) if available or refund you the price that you paid for the Product(s) through the payment method used by you when purchasing the Product(s).

5.4       If any Product(s) you have purchased from us is faulty, we will replace the defective Product(s) if replacements are available, or otherwise refund you the price that you paid for the defective Product(s) through the payment method used by you when you purchased the Product(s).

5.5       Subject to clauses 5.3 and 5.4 please use the link below to return the Product(s) to us.

Using this method to create your own return label will enable you to track your return and should be delivered to our warehouse within 48 hours (excluding Sundays and Bank Holidays). Please remember to include a covering note explaining the reason for the return and providing your details. You must return the Product(s) to us in all the packaging and documentation originally supplied.

5.6       Subject to clause 5.4 We will not however be liable for any fault in any Product to the extent permitted by law where that fault is the result of:

(a)   fair wear and tear arising from the use of the Product(s) or wilful damage to the Product(s) after delivery to you or for any damage caused by your negligence; or

(b)  your failure to comply with our or the Product manufacturer's reasonable instructions supplied or included with the Product(s) as to storage, installation, commissioning, use or maintenance.

6.      Privacy Policy

We are committed to protecting your privacy. Please read our privacy policy (‘Privacy Policy’) which explains how we will use any information about you that we receive, and our cookie policy (‘Cookie Policy’) which explains how we use cookies. The Privacy Policy and the Cookie Policy form part of these Terms of Use.

7.      Security Policy

All order details submitted through this site are processed through and held on a secure server. All website content is held in a secure, password protected database, and accessed solely by authorised personnel.

8.      Complaints

If you have an issue with any of our services or goods, please contact us either through the online contact form, or by telephone on 01209 705459. Complaints received by email will be acknowledged within five (5) working days.
